Terms of service
Terms of Service
These Terms of Service (“Terms”) apply when you purchase or access courses, certifications, digital learning content or related services through the Learning People online store (“Store”).
Please read these Terms carefully before making a purchase. By placing an order through the Store, you agree to be bound by these Terms.
1. About us
The Store is operated by [The Learning People UK Ltd], trading as Learning People (“Learning People”, “we”, “us” or “our”).
Registered address: Learning People, The Agora Building, Ellen Street, Hove, BN3 3LN
Company number: 15094686
Email: lite@learningpeople.com
2. Our courses and services
We provide digital education and training products, which may include:
- Online courses and learning materials
- Professional certification preparation
- Digital learning platforms
- Practice tests, labs and other learning resources
- Examination vouchers or exam-related services where specified
- Tutor, student or other support services where included in the product purchased
The exact content included in your purchase will be described on the relevant product page or during checkout.
You should review this information carefully before placing your order.
3. Placing an order
When you place an order, you are making an offer to purchase the relevant product or service.
A contract between you and us is formed when we accept your order and send you confirmation.
You are responsible for ensuring that the information you provide during checkout is complete and accurate.
We reserve the right to decline or cancel an order where there has been an obvious pricing or product-description error, suspected fraud or misuse, or where we are unable to provide the product or service. Where payment has already been taken and we cancel an order, you will receive any refund required by law.
4. Prices and payment
Prices will be displayed before you complete your purchase.
The total amount payable, including any applicable taxes or mandatory charges, will be shown before you place your order.
Payment must be made using one of the payment methods available through the Store.
If you choose a third-party finance or payment provider, additional terms may apply between you and that provider.
5. Access to your course
Where your purchase includes digital content, access may be provided shortly after successful payment and enrolment.
You must provide accurate account information and keep your login credentials secure.
Your access is for your personal use only unless we expressly state otherwise. You must not share your login details or allow another person to access paid learning content through your account.
6. Your 14-day cancellation rights
Consumers purchasing online will normally have a statutory 14-day cancellation period, subject to exceptions that apply to digital content and services.
Where you request immediate access to digital content during the cancellation period, we will ask you to expressly consent to the supply of that content beginning immediately and acknowledge that you will lose your statutory right to cancel once supply of that digital content begins.
Where these requirements have been satisfied and supply has begun, you will no longer have the statutory right to cancel the digital content simply because you have changed your mind.
Where your purchase includes services, different rules may apply to the service element.
Full details are contained in our Return and Refund Policy.
This reflects the rules for digital content: businesses must obtain agreement to immediate supply and acknowledgement of the loss of the 14-day cancellation right; otherwise the customer can retain that cancellation right.
7. Course availability and duration
Your product description will specify, where applicable, how long you have access to your course, learning platform or associated services.
It is your responsibility to complete your learning within the stated access period.
Any extension to the stated access period is at our discretion unless you have a legal right to an extension or the original service has not been provided as agreed.
8. Examinations and certifications
Where your purchase includes preparation for a professional certification, purchasing or completing a Learning People course does not guarantee that you will pass an external examination or receive a professional certification.
Certification may depend on successfully completing assessments or examinations administered by us or a third-party awarding or certification body.
Where examination fees or vouchers are included, this will be stated in the product description.
Third-party examination providers may impose their own booking, rescheduling, identification, examination and cancellation requirements.
9. Course and certification changes
Technology, professional certifications and employer requirements change over time. We may therefore update course materials to keep them relevant and current.
We may also need to make reasonable changes because of changes made by awarding bodies, certification vendors, technology providers or other third parties.
Where a material change affects what you purchased, we will act reasonably and in accordance with your consumer rights.
This is important: I would not give Learning People an unrestricted contractual right to change courses, prices or what a learner receives after purchase. The CMA specifically identifies broad unilateral variation rights as potentially unfair.
10. Intellectual property
All course materials, videos, documents, graphics, assessments, software and other learning content made available to you are owned by, or licensed to, Learning People or the relevant content provider.
Purchasing a course gives you a limited, personal, non-exclusive and non-transferable right to access and use that content for your own learning.
Unless permitted by law or expressly authorised by us, you must not:
- Copy or reproduce course materials
- Share your account or course access with another person
- Distribute or resell course materials
- Record, republish or commercially exploit our content
- Make course materials publicly available
- Attempt to circumvent technical restrictions protecting the content
11. Acceptable use
You must not misuse our Store, learning platforms or services.
This includes attempting to gain unauthorised access, introducing malicious software, interfering with the operation of our systems, using another person's account without permission or using our content unlawfully.
We may suspend access where we reasonably believe an account is being misused while we investigate the issue.
Where appropriate, we may terminate access for serious or repeated breaches of these Terms. This does not affect any statutory rights you may have.
12. Third-party services
Some courses, examinations, certifications, learning platforms or other services may be supplied or administered by third parties.
Their own terms may apply to your use of those services.
Where appropriate, we will identify relevant third-party requirements before purchase or before you use the relevant service.
We are not responsible for matters outside our reasonable control, but nothing in these Terms excludes any responsibility that we are legally required to accept.
13. Digital content and service standards
Nothing in these Terms affects your statutory rights.
Under the Consumer Rights Act 2015, consumers have legal rights relating to digital content and services. Among other things, services must conform to what has been agreed and be provided with reasonable care and skill, while digital content is subject to statutory quality requirements and remedies.
If there is a problem with something you have purchased, please contact us so that we can investigate and provide any remedy to which you are entitled.
14. Our liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms limits your statutory consumer rights or excludes liability that cannot legally be excluded.
We are not responsible for losses that were not reasonably foreseeable when the contract was entered into or losses resulting from circumstances outside our reasonable control, except where the law provides otherwise.
If you purchase as a consumer, we do not exclude or restrict liability in a way prohibited by consumer law.
15. Career and salary information
Learning People may provide information about careers, employment opportunities, industry trends, skills requirements and salary expectations.
This information is intended to help you make informed decisions but should not be interpreted as a guarantee of employment, promotion, salary level or other particular career outcome.
Actual outcomes depend on many factors, including your experience, qualifications, location, performance, the employment market and individual employers.
16. Promotions and discount codes
Promotional offers and discount codes may be subject to additional conditions communicated when the promotion is offered.
Unless otherwise stated, promotional codes:
- Cannot be exchanged for cash
- Cannot be applied retrospectively
- May be limited to particular products
- May have an expiry date
- Cannot be combined with another promotion where expressly stated
Any promotional conditions will not affect your statutory rights.
17. Privacy
We process personal information in accordance with our Privacy Policy.
Please review the Privacy Policy for information about how we collect, use and protect personal information.
18. Cancellation and refunds
Our cancellation and refund arrangements are explained in our Return and Refund Policy.
Nothing in either policy limits your statutory rights.
19. Changes to these Terms
We may update these Terms from time to time.
The Terms applicable to your purchase will generally be those in force when your contract with us was formed. We will not retrospectively impose material changes that unfairly reduce your contractual or statutory rights.
20. If part of these Terms is unenforceable
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
21. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you will retain any mandatory rights and protections available to you under the laws applicable to you, including rights relating to where proceedings may be brought.
